Voluntary Participation; Assumption of Risk. Customer is voluntarily entering the Property and participating in a self-cut flower activity. Customer understands that this activity involves inherent and obvious risks, including, without limitation, slips, trips, and falls; uneven ground; mud; holes; rocks; insects; bees and other animals; thorns, sharp stems, and plant materials; allergic reactions; sun, heat, weather, and other outdoor conditions; and the use or handling of scissors, clippers, knives, buckets, wagons, or other tools or equipment. Customer accepts and assumes all risks of injury, illness, death, and property damage arising from or related to entry onto the Property and participation in the activity.
Release of Liability. To the fullest extent permitted by Utah law, Customer releases and discharges Sweet Violets Flower Farm, its owners, members, managers, officers, employees, agents, affiliates, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses arising out of or relating to Customer’s presence on the Property or participation in the self-cut flower activity, including claims based on the ordinary negligence of any Released Party. This release does not apply to claims resulting from a Released Party’s gross negligence, reckless conduct, or intentional misconduct.
Indemnification. Customer shall indemnify, defend, and hold harmless the Released Parties from and against any third-party claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to (a) Customer’s acts or omissions on the Property, (b) Customer’s breach of posted rules or staff instructions, or (c) injury to any person or damage to property caused by Customer or by any child, guest, or other person accompanying Customer.
Responsibility for Guests and Minors. Customer is responsible for all minors and other persons accompanying Customer onto the Property. If Customer brings a minor, Customer represents that Customer is the minor’s parent or legal guardian and agrees to this release and indemnification on the minor’s behalf to the fullest extent permitted by law.
Rules and Instructions. Customer agrees to follow all posted rules and all instructions given by Sweet Violets Flower Farm. Sweet Violets Flower Farm may refuse or terminate access to the Property for unsafe conduct, trespass into restricted areas, misuse of tools, or failure to follow instructions, without refund except as required by Sweet Violets Flower Farm’s stated policies or applicable law.
Governing Law. This agreement is governed by the laws of the State of Utah, without regard to conflict-of-law principles.
Acknowledgment. Customer has read this agreement, understands it, and agrees that it is intended to be broad and enforceable to the fullest extent permitted by Utah law.
